Just posting a quick email response from the owner...WOW she's had a go of it...

In 2004 when he was showing the FEI 6 y.o. test (3rd/4th level) it became apparent in June that he was injured (stomach muscles from his hay allergy attack at Devon in 2002) and was ******** out with the changes (I figured this out when he did 5 one-tempi's in anticipation of a singe change on the diagonal in a test). So I put him into physical therapy/rehab and was going to bring him out at 3rd in 2005 when he'd had time to heal.

Then I got in a car accident in September, 2004 and herniated disks in my neck and low back and wasn't riding much (;>{) so I hired an FEI rider/trainer to work with him in January, 2005. She rode him 3+ times and broke her ankle in 5 places riding a colt for Carolyn Adams when she was supposed to be riding my horse. Then I decided I'd ride him again, but then I got involved in a huge trial (I'm a trial attorney) so I turned him over to my groom at her farm to give him R&R.

Then the trial went 3 months instead of the anticipated 3 weeks....and I let my groom show him (2nd level) and they won some awards with a median score of 67%+/-. Then there was a hassle with my groom (she refused to give my horse back and was breeding him and keeping the stud fees - without consulting with me....) and when I finally got him back, he'd lost maybe 500 lbs. and looked horrid. I brought him home and the vet said to gradually bring him back to health. I did, and in January, he went down to American Sporthorse to work with Alexsandra Howard (FEI trainer/judge etc.). The plan was that she'd bring him out at PSG in 2006.

After a couple months with Alexsandra, in May, it became apparent that he was not "right" (they said he was misbehaving) and I went to see him and immediately realized that he was really sore in his mouth. (I have a really hard time figuring out how they "missed" this...his lymph nodes were swollen and it was obvious that he was in big-time pain.) I took him to UC Davis the next day and he did not pass go or collect $200...he went into surgery (for 6 hours) the next day to have molar 109 (upper right) removed, which necessitated cutting his cheekbone away and hammering out the root from his sinus cavity while simultaneously having a dental surgeon in his mouth trying to pull down the tooth. Luckily, his sinus cavity wasn't badly infected and he had to be in rehab for 4 months after spending a week in horsey ICU. His mouth healed pretty good after having multiple acrylic plugs put in his tooth socket to protect his sinus cavity and he's eating again. He hated being on mush. The theory now is that he broke his tooh in 2005 while he was being mishandled by my former groom.....

While he was rehabing, I had a warble on his back removed too since he had down time. Luckily (for Duc) he was able to be bred over the summer and that was his big reward for all his medical procedures.

So, now I'm trying to figure out what to do with him next year. I haven't recovered enough from my car accident to ride him competently. I don't want to send him away where I can't see him mutliple times weekly and I don't really like most of the trainers in the area (at least for Duc). I hope to go look at a new Swedish FEI trainer at Toyon Farms on Saturday.

So that's the long answer why I didn't follow through with the NAWPN. Probably more information than you wanted to know.

I have questions about your mare, however. What is the highest level she has been competed? What types of scores did she get? Has she been shown jumper/hunters too? If so, how did she do? Did she have 2 foals or just the one by Briar? What is her extended pedigree? Do you have any actual videos instead of just the clips? (I have a hunch that your clips don't show off her jumping to her best advantage.) Why do you want a foal? Why aren't you riding your mare? How is she under saddle?

SHE'S DRAFTING A CONTRACT AS WE SPEAK!

(Though for a different arraingement-- She gets first foal and I get Queen back in foal, and we can continue the agreement from there.)

Breeding Lease Agreement

Lessor and Lessee agree to the lease of the above-described horse subject to the following terms of this agreement, for the term between February ___, 2007, and weaning of her foal conceived in 2007 (anticipated late Summer/early Fall, 2008.
  1. The parties agree that the horse is to be used by Lessee solely for the purposes of breeding to the stallion Gauguin du Cheval, owned by Lessee. Lessee acknowledges that the horse may be ridden as beneficial for the horse.
a) Lessor hereby agrees to allow the horse to be shown in hand or under saddle by Lessee or Lessee’s agent for the purposes of breed and/or foal inspection. Lessee agrees to advise Lessor when and where the horse is to be shown, if at all.
b) Lessee acknowledges that she has been advised by Lessor of a pre-existing condition of ___________________ in the horse.
  1. Lessee agrees to care for the horse in a manner that ensures the horse’s health and well-being; including adequate and proper food, water, shelter, shoeing and veterinary care, including regular vaccinations and worming as appropriate for the region in which the horse is kept. Lessee further agrees to provide adequate exercise for the horse in the form of turnout in a safe area large enough for the horse’s freedom of movement at the walk, trot and canter. Lessee agrees to provide turnout for the horse on a daily basis barring circumstances such as disaster, emergency, or extreme inclement weather, which makes turnout of the horse impossible. In exchange for caring for the horse properly, Lessee is hereby released from lease fees or charges, and may breed the horse via artificial insemination to the stallion Gauguin du Cheval.
  1. Lessee agrees to keep Lessor notified of the horse’s whereabouts and condition at any given time, and agrees to advise Lessor of changes in the horse’s whereabouts and condition. Lessee agrees to give Lessor access to the horse at any time.
  1. Lessee agrees to release Lessor from any liability for damage, accident, or injury to person or property caused by the horse while the horse is in Lessee’s care.
  1. Lessee agrees to attempt in good faith to return the horse to Lessor at the end of the lease term in foal to the stallion of Lessee’s choice for a 2009 foal.
  1. The parties agree that the lease may be terminated at any time by either party, subject to the following terms:

a) The lease may be terminated by the Lessor should the Lessor determine that the horse is not being treated or maintained properly; or she is denied access to the horse. The Lessee may terminate the lease in the event that the horse proves to be barren or unable to carry a foal to term, or she does not wish to provide further care for the horse.

b) Should Lessor wish to terminate the agreement for cause as set forth in paragraph 5a, above, and the horse is currently in foal, the foal shall remain property of the Lessee, and Lessee agrees to incur all expenses related to the gestation, delivery and keeping of said foal, even in the event that the horse is removed from Lessee’s care. Should Lessee wish to relinquish ownership of the foal, she is released from financial liability involving the foal’s gestation, delivery and keeping; however she remains responsible for veterinary bills and other charges for the horse and /or her foal resulting from Lessee’s neglect or mistreatment of the horse and/or her foal.

c) Should Lessee wish to terminate the lease, she agrees to continue to care for the horse adequately and properly for a reasonable time to allow Lessor to make other arrangements for the care of the horse. Should Lessor be unable to make other arrangements within sixty (60) days of notification of termination of the lease, she agrees to pay Lessee monthly or weekly board equal to the actual cost of feed, supplements, shoeing, veterinary care, etc. incurred for the benefit of the horse until the horse is removed from Lessee's care. Should Lessee wish to terminate the lease before the lease term is completed and the horse is in foal, Lessee agrees to either continue to assume financial responsibility for the care of the horse and foal or to relinquish her ownership of the foal. Lessee agrees to incur shipping expenses for the horse should she wish to terminate the lease before the lease term is completed.


I/we the undersigned hereby agree to be bound by the terms of the agreement above-stated.

My friend has a Gaugain du Lully-mare that just keep popping out super foals! Very nice to have that bloodline in a stallion (even if he's grey, he he).

Great to hear! I don't know much about the line, but he sure seems like a nice stallion.

I am making sure she adds into the contract that if I choose to breed Queen back to him the stud fee will be waved.
