Well Lets just hope that the district court has a conscious in this one since the eyes of the rest of the nation are on them now.

Oh how wonderful.

I believe a few are in the hands of some wonderful people that are more than willing to not only help determine the value of the rest of the herd, but help return a few of their stock!!!

Unfortunately some of them were stallions and I am not sure that they are still stallions and in breeding condition... so I hope they can correctly determine the loss. I wonder if those with the AC who were behind this will apologize and try to correct their error. Anyone want to take bets? I doubt that they try to remedy their wrong.

Yea and I wonder what will happen to the two or three that " dissappeared" and were " adopted out" to some one that the animal control doesn't know where they went to.

They had some VERY nice stallions, and unfortunately I believe they were gelded.

I am glad there is going to be SOME justice, but unfortunately I do not think that these gentleman will ever get full value or ever fully recover.

Thank god the judge ruled for them. I would have been terrified to continue to be a horse owner in MI if he had not. AC would have gotten away with doing whatever they wanted.

Thats just horrible. I'm glad the judge had the gall to rule in this guys favor and go against the city. He probably got a lot of heck from the city counselors...

This story was almost as big as thinking Jimmy Hoffa was buried under an old barn in Milford. I don't think MI cleaned that up either after tearing the guys property apart.

As a country of citizens we are 'allowing' the government to take over. We get fed up and mad and talk but a lot of times things are not done. Some are taking a stand but others just sit by and complain,, it's someone elses job, not mine.

I'm so glad the ranch was able to win this one and we need to keep fighting them. our freedoms have been taken away, this isn't america anymore. We've lost it. Those who want to control are doing it. We need to raise our voices up and let them be heard. Online, outside, We are many, they are few. There should be no sense in them controlling us like this. NAIS needs to go stick their heads under the dirt and leave it there!

I have followed this story as well and was shocked when I first heard it. Scary.

THank goodness at least the judge has some commen sense and I hope that the sue to pants off some of the "individuals' who were less then scrupulous. May heads roll! (in a non violent sense )

What also amazes me is that they SOLD the animals without just cause. How can they do that?

I realize this post is a little over a month old, but I had to say something. Sort of an update.

I am friends with Matt Mercier from Turn 3 Ranch. I believe they were awarded $500,000 for the horses that were seized. That averages about 7,200 for each horse seized. $14,400 for both of the stallions sold is chump change. Sky High Fame (Dash Ta Fame's Leading Paint Son and only APHA Stakes Placed Son) and Buggy Full of Money (AQHA champion race horse and champion barrel horse) are phenominal stallions that shouldn't bring less $25,000 each. Two of the horses sold at auction are at the barn that I board at. Both are very nice and one is a dream to be around.

Unfortunatly, I think the amount they were awarded is not enough for the harassment, defamation of character, slander, and libel they went through. I hope they do sue the Jackson County Animal Control (JCAC). Hopefully by the time the whole thing is over the $500,000 will be more.

Last I heard, JCAC is planning on appealing to the case. According to the prosecutor, and I quote "We will be appealing this, no doubt about that because if they don't, the county will have trouble paying Henderson back."

Penny:
There is a lien on the horses, but unless they were kept track of,many were sold at the auctions to one person and changed hands, some several times removed from the original purchaser, no paper trails to follow.
But they do have the opportunity to find them as AC promised the papers were free and clear, and many are looking to get the papers on the horses. So, the guys will have the opportunity to locate and reposess these horses by that means. Either way, the whole situation sucks. It shouldn't have ever gotten this far, and it should be up to AC to find these horses, not Matt and Jim. Judge Filip had them sign transfers on all the horses they had papers for in the courts possession that were confiscated in the initial take over of the property....but that both breed assoc. (AQHA and APHA) told Jim they would not accept them until the outcome of the trial was decided.
