I hope every one gets it through their heads that this is EXACTLY what NAIS under the USDA will be like for the rest of us.

Because USDA believes they have every right to come on to anyones property with out a warrent and conduct search and seizure operations with warrents.

Be prepared for this kind of thing by having a public servant questionair that reguires by federal law, the pubic official entering your property with out a warrent to fill out if you present it to them.

I'm confussesd!!! Where the horses seizes becuz they were neglected or were they seized for no reason???? I don't recall this story? Can someone fill me in? Thanks

There were Three horses on their property out of 69 total horses that were thin and in need of some kind of medical care. read these all the way through

I really hope those guys sue! This whole thing was utterly ridiculous from the beginning. I know even if they were to sue and win it probably wouldn't stop this from repeating but it's worth a shot.

Unfortunately many just do not get this TD. I know that you and I and a few others are on the same page on this one... but many still do not think this can happen to them. If NAIS passes this will or can happen to ALL of us in short order.

What a shame, those guys lost all their horses for nothing....I hope they can counter sue for their monatary (sp?) loss.....I am glad they won their case...

According to Ronald J. Fabian, attorney for Matt Mercier, the horses' caretaker, Circuit Court Judge Thomas D. Wilson ruled that there were no reasonable grounds for Henderson to forfeit his horses. Wilson also ordered the county's District Court to determine the value of the horses--most of which were sold to cover the cost of their care--and pay Henderson that sum.

In March 2007, Henderson and Mercier were each charged with three counts of felony animal torture and one count of misdemeanor animal abuse after Jackson County Animal Control authorities seized a total of 69 horses owned by Henderson from a ranch operated by Mercier. The felony charges were dismissed last month by Circuit Court Judge Chad C. Schmucker.

Neither Mercier's attorney Michael ****an nor prosecutor Jerrold Schrotenboer were available for comment.

It is great that they were found not guilty. What a waist of time and money for everyone. Wasn't the District Court in charge of the seizure? How are they going to determine the value of the horses fairly. I have a feeling he won't get more than a couple hundred dollars for each horse. The of course he will get taxed on that too.
