You'll need to speak to a civil attorney. It will likely end up being a contract dispute. Have you moved your animals?

Smile

If it is the manager why not take the problem to the actual owner of the boarding facility?
If the manager is the owner then MOVE your animals!

The following site might help you find a attorney: http://www.hierosgamos.org/hg/db_law...ategory=Equine

If you can't find one that specializes in Equines look for one the specializes in CONTRACTS.
You do have a boarding contract I hope!!!!!?????

Contract or not even a verbal agreement should be binding. Especially if they have been caring for the animals. If the manager is not the owner then you'll likely get satisfaction from the owner. I'm sure they don't want to end up in court.

the barn owner will only be liable if they KNOWINGLY let it continue.

if they did not know of the actions.....they cannot be held liable.

That is law.

Seen enough court TV as well as been through some law classes to know that one.

And if the barn owner WAS knowledgeable...then they SHOULD be held accountable.

Bingo Blistering Winds!

I am not sure of the fine print stuff where you live msmolly, but in most states this type of issue would be handled by a civil attny. If the one you spoke with did not want to take the case or misunderstood your desires they would have brushed you off by stating you needed an equine attny.

Keep looking for an attny to talk to about this case (but make sure you get a free consult before talking with them other wise you will be paying everybody you talk to) and never close the door just because an attny is not interested.

I may also suggest that you speak with the county attny about this case as they may be able to put something "on the record" if you are not going to full civil litigation.

You also say you do not wish to move your horse. That point will hang you in court.

You won't call AC. that will hang you in court.

You are creating a worthless case after I've had time to really re-read your statements.

You MUST get AC involved. As SOON as they leave, set up a meeting with AC so they can document that your horse was NOT fed.
Continue with video cameras to prove your horse wasn't fed earlier than the others and they just finished up quickly.

You need PROOF beyond your word to do squat.

And you need proof that you TRIED to change the situation with some judges.

have you MENTIONED to your barn owner the situation? Could the feeder be mistaken to think you are supposed to take care of your own horses?

From the information you've provided, you have no case.

You haven't used the avenues set forth by the law to resolve the situation.

You haven't filed a complaint with the barn
You haven't called Animal Control

And why the HECK wouldn't you move your horses from a facility you KNOW doesn't care about your horses???

If you haven't exhausted your options for correcting the situation, no judge is going to grant you damages...you are as much at fault in the eyes of the law as the BM is....
