2 years ago some friends of ours had a gelding that was causing problems on their breeding horse farm. We agreed to let them bring him to our house, now two years latter they want us to buy the horse. I have read the law in my state about Liens on Personal Property or the Agister's Lien. Does anyone have any more info on this? Or a web site? Do I have to file this lien in my county court? Thank you, Sunflower1225 |

Did they pay board on the horse for the two years, or just leave him there. If they left him there with out paying board you can legally get custody of the horse, however if you sell it for more than they owe you, you have to give them the difference. This is how my Equine Business Management Prof. explained it and he is a lawyer. If you give me more info i can find out for you my mom is also a lawyer and i can ask her

Thank you RubySlipper for the info you provided me. I didn't know you could actually get custody of a horse. What the basic things to do in this situation if that would be our option. The Lien on Personal property in our state reads until we are paid for care and keep of the horse that we may retain possession of it, but we don't want their money, they didn't want the horse, thats why he is here. We just want ownership or a bill of sale for the horse. Well if you can help any further I would appreciate it. I will speak to my attorney about this suggestion. Have a nice day! Sunflower1225 |

I'm not sure what your original agreement was, but if it was that you would keep him for free, you aren't going to get anything without paying them for the horse. So unless you stated a board price to begin with, you really don't have a case against them.
