Colour question

Hi
I was wondering if you guys could tell me what colour you think that this foal will end up. Do you think that he will turn black? The pictures aren't the best and I hope to get more soon.

They're hard pictures to tell from, but I'm going to say there's a good chance he'll be bay. But, I'm not an expert by stretch.

The mare is a faded black. She is black in the winter and fades to a dark velvety brown in the summer. She also has a slightly browny red (auburn?)tinge to her mane sometimes.
The sire is a sorrel and white tobiano so I guess his colouring has not affected the foals colouring at all. The foal looks like a grey/brown colour.

Really cant be sure and give fair guess by these pics. The lighting might very well be confusing the true shade.

If you have not tested your mare for agouti how do you know he is black instead of brown? What color is the sire and dam of your mare?
