Buying a new horse with out Papers and not tested HYPP? HELP WHAT DO YOU THINK????

I am new to the site and would love to get some other horse lovers input on this. I am buying a new horse MABYE?? she is a 9 year old APHA but not reg yet she is asking $3500 she first said $3000 and now she is asking $3500 sense she needs to send in the paper work for $500 through APHA she has impressive blood line and has not been tested for HYPP but the sire that has the blood lines is HYPP N/N and I have been told it cannot skip over the sire or dam and so to top all this off she had her mother call me to explain the gentics ok little weird and I just sent off the agreement to purchase and $750 to hold her so she can get the papers what Iam I doing what would you do???? can I get out of this agreement
. This agreement is made between
herein after referred to as the BUYER and
herein after referred to as the SELLER for purchase of horse described below.
NAME- ”COOKIE”
D.O.B-___5/6/1999 Reg. # __________________________(pending)
Sex - Mare Gelding Stallion
Color- Black and White Tobiano Markings - Star & Snip
2. The BUYER understands and agrees to the following total price of $__3500.00 .
The SELLER agrees to sell and the BUYER agrees to buy said horse based on the following terms:
3. A down payment in the amount of $ 750.00 has been received by the SELLER.
4. The balance due is $ 2750.00 which will be paid in monthly lump sums of $1375.00 by the BUYER and be received by the SELLER on the 5th day of each month. If the BUYER is for any reason unable to make agreed scheduled payment on date agreed, then a charge of $10 per day will be added to monthly payment for each day late.
5. If BUYER is unable to complete the transaction in full and/or meet scheduled payments (including any late fees) and falls more than 60 days behind, the said horse will be returned to the SELLER in satisfactory condition and the sale will be nullified and all payments already made will be forfeited.
6. Horse will be paid in full by April 5th, 2008_/ as long as all registration paperwork is in order.
7. The horse will be kept at SELLERS facility until 2nd payment of $1375 is paid.

8. The SELLER warrants that they have clear ownership of said horse.
9. The SELLER disclaims the following health concerns (if any) about said horse. None Known
10. The SELLER makes no other warranties expressed or implied, including the warranty of fitness for a particular discipline, and BUYER agrees to purchase said horse “as is.” A “vet check” is recommended.
11. In the event that the horse becomes ill, permanently disabled, or dies, the party in possession of said horse is responsible. If any of the above happen while horse is under contract, but still within SELLERS care, all monies will be returned to BUYER. If any of the above occur while in BUYERS care or responsibility, BUYER agrees to fulfill the terms of payment in full unless other arrangements are made between BUYER & SELLER.___________________________________________ ____________.
12. Upon payment in full, SELLER agrees to execute and provide all necessary paperwork (such as: Brand inspection, health certificate, coggins, registration papers, Transfer papers) for said horse to BUYER. BUYER agrees to pay all fees. Other arrangements- Seller will provide registration papers, transfer report papers and clear brand inspection report on buyers pick up date (please allow 2 days notice)

13. S YES, SELLER wishes to be notified if said horse is ever offered for sale.
14. Either party may nullify this Agreement if the other party breaches a material term of this Agreement. The wronged party may recover reasonable attorneys fees and court costs.

and http://www.allbreedpedigree.com/two+tone+barlink does anyone know about the agreement if i can get out of it? I know that sound bad to get out but this deal is getting weird.

This is true If the Impressive-bred parent is not a carrier, it has nothing to pass on! You should be safe in that aspect. Good luck.

I don't know much about contracts, but she is right about HYPP not skipping generations. If the only horse that traces to Impressive is N/N, your (future) horse is N/N.

Can you post the pedigree and/or photos?

Why are you willing to pay that much extra when the original price was less?

That's what I was thinking.

It's their fault for not registering the horse when the horse was younger.

I bought a 5 year old Paint who had his breeding certificate, but they never sent it in. I told them to knock $600 off his price because it was going to cost me that much to register him. [I just registered him Pinto afterwards, didn't care about Paint Papers]

If the horse was advertised as $3000 I would not pay a dime more. Especially in todays market. The horse would have to be broke at that price too.

By the way the HYPP is not an issue because the parent with the Impressive breeding does not have it to pass on. The papers are automatically NN but I do not think APHA cares about it enough to print it on the papers.

I would call APHA and ask about the money and the breeders certificate and if everything is in order for the papers.
