Am I out of line or is this guy just trying to get some extra cash?

Hello! I am new I have been looking through the forums and have gleaned some great info. I just have a quick question and I hope that I am posting it in the correct location....

I bought a horse that was professionally trained. It was written on the bill of sale, I have perused the website that advertises their training, and I have talked to the owner via email.

Recently, I decided to possibly sell the horse. When I put the ad out for her for sale I mentioned that she was professionally trained and the name of training barn so people could see what type of training she has had.

Anyways, the very angry owner of the training stable told me that I do not "own" her training like I own the horse and that I cannot tell people where she was trained "because he doesn't want to be bothered" in case they try to contact him. He said if I insist on telling people where she was trained he will charge me a 10% comission on her sale.

I have NEVER dealt with this before in all of my years. Her chances of selling are way higher if people know she was professionally trained and can see where (the website)....

Anyways, please let me know if I am completely out of line or if this guy is just trying to get some extra cash

You're not out of line and if he's that ashamed of his training, then maybe he needs to rethink how he's training his horses.

Let him blow, there is NOTHING he can do about it other than blow if you have proof that the horse was with him during the time stated.

Unbelievable. It's a part of her description. The same as it would be to mention the stallion and stud farm if she was bred. How rude of him. if he doesn't like dealing with phonecalls he better closes up the business.

Your horse must be drumming up quite a bit of interest if he's getting THAT many phone calls!

He can't charge you anything without an agreement, but I bet he will start lying and saying she wasn't trained there. If he does that and you have proof the horse was trained there I bet you could file a civil suit of some sort (you'd have to talk to a lawyer).

Its probably best if you post a note next to were they were trained that they have asked to not be contacted, but show that you have proof.

The only reason I could see he would have an issue with it is if he thinks that you might have "undone" his training and doesn't want his name to be tarnished because of the person who owned the horse after him.

That being said, it doesn't sound like that is what he is saying at all, and I agree with DB - let him throw a temper tantrum, it's not going to get him any where.

lol...that is what i thought...thank-you all.

he contacted the place where i posted my ad and they have suspended my account JUST because I mention that she was trained there. It is a pretty prominent training barn I guess so I am not sure why he has such a problem. free advertising Is there any laws that you know of that say I can NOT say where my horse is trained? I am not interested in a legal battle,but I want to continue to say where she is trained.

This is a tough call. A trainer will sell a horse from his/her barn with their name attached. The horse is most likely on a regular training program with that trainer. Once the horse is sold and not in his/her training program at times the trainer does not want to have their name attached. If a horse falls out of a regular program often the horse will not perform as it did with that trainer. This is not to say the horse does not perform well. But, you are using the name of a trainer to help you advertise the sale. Is this your trainer? Do you have other horses in training with that trainer? If the trainer is well known people may call him/her to ask about the horse. Phone calls take time, so this may be why he's asking for commission. Or he is gently asking you not to use his name in the sale.

In ALL of my ads I put a note beside it asking that no one contact the training place by phone/email or other means and to contact me directly. My ads were deleted and account suspended anyway

I am just not sure what action to take next. He has called my phone,but I have not answered because I want every conversation to be recorded in some way.

Well, I'm sorry, but that's ridiculous. Which site is it that deleted your account? Did they not even give you a chance to edit your ad to their specifications? That seems pretty shady to me!
