That won't hold up in court at the state level. Commercial horse haulers and Ranchers are most likely to fight that one, and Texas has some really wealthy ranchers who would be willing to take that case to court. Basically if Rancher A in Texas is hauling horses to Rancher B in New Mexico And has to stop every hour to unload mares and foals or unbroke weanlings etc Thats just an accident waiting to happen. AND if the horse is leaveing the state it's also an interstate commerce issue.

Maybe some one should visit with the Texas idiots and ask them how many "load and unload" facilites is the state willing to provide for this. Ie we need a rest area bascially every 40-50 MILES of texas highway road.

Quote:
Tucked away in Article I, Section 8 of the United States Constitution is the Commerce Clause, which states that "Congress shall have Power … To regulate Commerce with foreign Nations, and among the several states, and with the Indian tribes." The Commerce Clause clearly grants to Congress the power to regulate interstate and international commerce, an interpretation that has been upheld repeatedly by the United States Supreme Court. An implied, but widely recognized, corollary is the so-called "dormant" Commerce Clause, which places limits on the power of an individual state to regulate interstate and foreign commerce
Additionally:
Quote:
To survive a Commerce Clause challenge, a state law must satisfy several criteria. The law must meet a legitimate state interest, it must not discriminate against out-of-state businesses in favor of local businesses, any regulation of interstate commerce must be incidental and minor, and any costs imposed on interstate commerce must not be excessive. While the humane treatment of horses and other animals is a legitimate state interest, no single factor is controlling. All must be considered.

I am trying to find that info again. I had it up last week to send to someone and can't find where I saved it at. I will search my other board.

No, I don't see it passing either, but this is the first stage of looking at horses like "pets" or companion animals rather then livestock. Don't get me wrong. I love my girls and the old stallion that my mare is bred to. I really would go to the ends of the earth for them if I had to, but they are still livestock. They are not like my boxers....

I'd love to make those men live in a situation like that put those horses through. That is awful. Those poor horses! And poor foals who didn't have a chance. Why do you keep horses you can't care for? It's absurd.

At the time you posted asking me this, yes I had read EVERYTHING that had been posted; I see conflicting opinions in what occurred. I do NOT see an AC seizing such a large quantity of horses that they will have to fund to care for unless it was seen as necessary. I DID NOT see, at the time you posted this question to me, anything PROVING their innocence- that's why we have TRIALS, and ppl have a right to come to their own conclusions, which is what I have done at this point.

You imply that AC is always on the money. They are not. There are quite a few (this group in Jackson County) that are greedy and money grubbing and ALL about getting themselves an episode of Animal Cops. They are notorious through out Jackson County for engaging in gestapo tactics.

I just hope you are never on the receiving end of an injustice to this level. It will make you re-think everything you believe in.

As a side note, ask yourself UNBIASEDLY, what abuse/neglect case that is legit would have Animal Control's own veterinarian AND the 1rst most highly recommended Horse Rescue group called onto the property as the DEFENSE'S witnesses??????

I have to add, I don't find it very hard to believe the AC is corrupt. I think we tend to take for granted these organizations are good and can't do any wrong, which is very far from the truth!

It is because of people who hear "abuse" and dont check their facts before shouting "OH MY GOD!" that GOOD, RESPONSIBLE horse owners such as these two get in this kind of hopeless mess!!!!!!!!!!!!!!! AC ,in this case, is WRONG!
