Texas Authorities Seize Horses, Other Livestock

More than 30 horses are among 386 animals in SPCA of Texas custody after authorities seized them from a petting zoo located behind a Dallas County feed store.

Dallas County law enforcement authorities and SPCA of Texas personnel removed 34 Miniature Horses and one Paint horse, along with other livestock, from the Kearney Store in Sunnyvale, Texas, on Tuesday.
The Miniature Horses were used for pony rides, said Dallas County Constable’s Investigator Mike Missildine.

Veterinary assessments are under way to determine the horses' condition. SPCA spokesperson Maura Davies said seven of the minis are laminitic.

Earnest Kearney is charged with one count of Class A misdemeanor Animal Cruelty. If convicted, he faces maximum penalties of a year in jail and a $4,000 fine. He was unavailable for comment.
A hearing to determine the animals' permanent custody is slated for Oct. 15.

That makes me sick and all hes possibly gonna get is a yr and 4000 in fines. Your kidding me! Thats horrible!

That is an insane amount of animals. And it was at a, I'm assuming public petting zoo? Behind a feed store? Why on earth did it take so long to have action taken?! I'm sure the smell alone must have been a clue as to what was going on here and people had to have seen them. For shame.

Wow that sure it quite a lot of animals to be taken! I agree, if it was a public petting zoo, I'm sure someone has seen those hooves before and the other condition of the animals!
